On July 10, 2025, a pro-choice judge in the state of New Hampshire granted rights to the unborn. The case in question, filed as a class action, was initiated by the same people who scream “My Body, My Choice. ”
The suit was filed in an effort to block President Trump’s Executive Order 14160 which terminates birthright citizenship. The judge in the case, Judge Joseph N. Laplante, of the U.S. District Court in New Hampshire was asked to protect unborn babies under the Constitution. (Yes, you read correctly: He was asked to provide constitutional protection to unborn babies)
The plaintiffs argued that “it would cause irreparable harm to the unborn children of those immigrants.” They sought a stay on the order because these unborn children needed legal protection now.
Judge Laplante agreed with the plaintiffs and certified the case with a ruling that explicitly includes unborn children.
That means that for the first time in a federal courtroom, unborn babies have been granted legal standing under the 14th Amendment.
With Judge Laplante’s ruling there now exists a certified judgment that states that the government cannot harm the unborn and are bound by the constitution to protect life in the womb, because they are considered a person under the law. This isn’t semantics; it is a legal precedent and now the door is wide open for future lawsuits to protect the unborn; not just in the case of immigration, but all across the board.
The irony of it all is this did not involve a single conservative voice. These were pro abortion Democrats grasping at anything, trying to hinder the Trump presidency and in their headlong commitment to “resistance” have issued the most powerful argument against one of the key platforms in progressive politics: The rights of a woman to abort her unborn child. It is going to be difficult to maintain the “my body, my choice” mantra while at the same time asserting that unborn children deserve constitutional protection.
I, and many others, have long maintained that life begins at conception, and now, so does legal protection of it.
The Plaintiffs’ Class Certification Motion: JUNE 2025: “Inclusion of unborn individuals in the protected class is necessary to prevent irreparable harm before birth.”
The Judge Rules: “This court hereby grants class certification for all individuals unborn and born who would be subject to Executive Order 14160.” Judge Joseph N. Laplante, U.S. District Court, NH; July 10, 2025
